SC rejects petition for holding fresh elections

New Delhi, Nov 17 (UNI) The Supreme Court today refused to entertain a petition seeking directions to the Central government and the Election Commission of India to hold fresh elections in the country on the basis of the final determination of the delimitation commission according to the 2001 census.

A division bench comprising Justices K G Balakrishnan and D K Jain while permitting the petitioner to withdraw his petition granted him liberty to make a representation to the concerned authorities for enforcing the report of the delimitation commission.

The court made it clear that it was a political decision which was to be made by the President of India on the basis of the recommendation of the Union Cabinet and the apex Court cannot issue any directions to the Cabinet to notify the date of implementation of the report.

The petitioner has also prayed for directions to the authorities to publish the orders of the commission where ever a determination has been made for its implementation in accordance with section 10 of the Delimitation Act 2001.
