SC adjourns chamber hearing on Shaukat's curative petition
New Delhi, Nov 17 (UNI) The Supreme Court has adjourned chamber hearing on a curative petition filed by Shaukat Hussain Guru sentenced to 10 yrs imprisonment in the December 13 attack on Parliament House.
The hearing by a bench comprising Chief Justice Y K Sabharval and Justices K G Balakrishnan, B N Aggarwal and P P Naolekar could not conclude the discussion in the two sittings held last week and this week.
Mr Shaukat has challenged this conviction and sentence for concealing the information of conspiracy from the police on the ground that he was never tried for an offence under Section 123 of the IPC and no charge was framed against him under the aforesaid section by the trial court.
He was sentenced to death by the trial court and the punishment was affirmed by the Delhi High Court.
The Supreme Court however acquitted him of the charge of murder but held him guilty of the offence of deliberately concealing the information regarding the conspiracy thereby facilitating the commission of offence which resulted in the death of about 9 security personnel. All the militants involved in the attack were also killed.
