HC admits petiton of MNS party worker against Malad ACP
Mumbai, Nov 16 (UNI) The Bombay High Court today admitted a petition filed by a Maharashtra Navnirman Sena party worker against Assistant Commissioner of Police, Malad Division, who allegedly threatened the petitioner of killing him in an encounter and abused him on religious grounds for belonging to a minority community.
A division bench comprising Justices S R Sathe and S B Mhase also stayed the chapter proceedings against petitioner Rizwan Siddiquie until the disposal of the petition.
Siddiquie, who resides in a chawl at Malwani, had filed a complaint against another chawl member for allegedly selling illicit liquor from his house and creating nuisance in the residential vicinity.
Sebastian Saldhana, who according to petitioner belongs to Arun Gawli's gang, had also filed a counter case against Siddiquie and his friends for playing carrom outside his house and disturbing him.
According to the petitioner, during the first hearing of the said dispute before Special Executive Magistrate and Assistant Commissioner of Police, Malad Division, Suhas Patil abused the petitioner because of the caste he belonged to, on the lines that the nation was suffering because of the minorities.
The petitioner further alleges that the ACP threatened him of killing him in an encounter and threatened his Hindu friends for supporting a traitor.
While the ACP has submitted in his affidavit that the police is taking action as per the law against the petitioner as well as Saldhana to prevent any mishaps from occurring and maintaining peace, has not denied the allegations made by Siddiquie.
The case will come up for final hearing in due course.
