SC directs P K Dubey to follow High Court order
New Delhi, Nov 14 (UNI) The Supreme Court today directed Mr P K Dubey, legal advisor to Uttar Pradesh Governor T V Rajeshwar Rao to report to such place as may be directed by the Allahabad High Court on or before November 24.
A bench comprising Chief Justice Y K Sabharwal, Mr Justice C K Thakker and Mr Justice R V Raveendran issued the directions in the controversy arising out of the Governor's refusal to relieve Mr Dubey, who has been on deputation from High Court despite an order from the Court which had appointed him as a district judge.
Mr Dubey has been placed under suspension by the High Court.
The Apex Court said the Additional Solicitor General had informed it that the Governor had relieved Mr Dubey. He should report to the High Court on or before November 24. There is no question of the High Court being vindictive towards its officer, the Court observed.
It will be open to the respondent to make such representation to the High Court as he may be advised. "We have no doubt that it will receive the consideration it deserves. The High Court would also consider that the officer making the request for being relieved was unable to report to the court in view of specific order passed by the Governor," the Judges said and ordered the petition to be listed in the last week of November.
The Supreme Court made an appeal to all concerned parties to give a quietus to the controversy. It was assured by the Additional Solicitor General Gopal Subramanium, counsel for the state of UP and counsel for Mr Dubey of full cooperation.
