HC restrains MCD from demolishing building in West Delhi

New Delhi, Nov 14 (UNI) The Delhi High Court today directed the Municipal Corporation of Delhi (MCD) not to demolish a building, which was claimed to have been constructed before January 1, 2006, in Subhash Nagar of West Delhi till the final order.

A division bench of acting Chief Justice Vijender Jain and Justice Rekha Sharma asked the authorities not to further demolish the building.

Adjourning the matter till November 16, the court asked the MCD to file a reply to the petition filed by its owner claiming the action of the authorities as illegal and unauthorised.

Rekha Bajwa, the onwer of the building at 11/1 Subhash Nagar near Rajouri Garden, alleged that the MCD authorities had demolished about 70 percent of the building which was constructed much before the enactment of the law by Parliament.

The matter would come up for hearing on November 16, along with the main petition of Kalyan Sansthan dealing with illegal constructions in the capital.
