SC dismisses plea for CBI probe against K'taka CM
New Delhi, Nov 13: The Supreme Court today dismissed with cost a PIL seeking CBI inquiry against Karnataka Chief Minister H D Kumaraswamy and his family members for acquiring assets beyond their known sources of income .
A bench comprising Chief Justice Y K Sabharwal and Justice C K Thakker expressed serious doubts about the bonafide of the petitioner Sri Subhash A.R., an advocate while imposing a cost of Rs 10,000.
The court even refused to adjourn the matter and in its order said, "We have serious doubts about the bonafide of the petitioner who is a member of the legal fraternity. We are not concerned with the merits or demerits of the case. We are concerned with the bonafide of the person approaching this court by way of a PIL.
We say no more at this stage. Let the appropriate person approach this court. We decline to entertain this petition and dismiss the same with cost quantified at Rs 10,000." Senior counsel Mukul Rohtagi submitted before the court that since the material on record was authentic, the petition may be adjourned at least for a week to enable him to bring on record the real person.
The court earlier said that a lawyer could not lend his shoulder to anybody else to shoot from, by remaining behind the scene.
