Kidwai Institute: Amendment to C

Bangalore, Oct 27 (UNI) The Karnataka High Court today declared as void, the C and R rules amended on May 9 last for selecting a Director for the Kidwai Memorial Institute of Oncology.

Allowing a writ petition filed by Dr Ashok M Shenoy, Professor and Chairman, Department of Head and Neck Surgery, challenging the appointment of Dr B P Bapsy as Director and the rules, Mr Justice Anand Byrareddy declared the impugned amendment as inconsistent with the MCI regulations as it prescribed additional requirement of minimum qualification of ten years administrative experience for the post of Director.

The petitioner contended that without an advertisement, a circular was issued by the institute on June nine, calling upon professors and assistant professors to furnish their biodata before the Selection Committee for the post of Director by June 12.

The C and R regulation was amended in a meeting held on May 9 and the new amendment enabled only Dr Bapsy to be eligible for the post.

There was total lack of transparency and bias in favour of the respondent, besides being violative of Article 14 and 16 of the Constitution as well as selection norms, he submitted.
