HC upholds CAT order in appointment to IPS

Chennai, Oct 27 (UNI) Madras High Court today upheld an order of the Central Administrative Tribunal (CAT), setting aside the select list of 1994-95 as finalised in 1999 for selection and appointment to IPS in so far as suspended police official P Sivanandi and another officer S Avudaiappan are concerned.

A division Bench comprising Mr Justice P Sathasivam and Mr Justice S Manikumar upheld an order of CAT dated May 5, 2006, while dismissing a petition filed by Mr Sivanandi, challenging the CAT order.

Originally, Rajiv Kumar and others IPS officers moved the CAT, challenging the appointment of Sivanandi to IPS from November 3, 1995. The appointment of Sivanandi and nine others was passed based on the recommendation of the Select Committee, approved by Union Public Service Commission (UPSC), on July 14, 1999.

Rajiv Kumar and others contended that the Annual Confidential Report (ACR) which was written after March 31, 1994 would not be valid in the eye of law as it was written much later and the CAT set aside the select list. Hence Sivanandi preferred the present petition.
