HC directs DGP to probe proposed chargesheet and take action

Mumbai, Oct 20 (UNI) The Bombay High Court today directed Maharashtra DGP P S Pasricha to examine the documents submitted by the Criminal Investigation Department, alleging involvement of 14 police officials in the custodial death of Ghatkopar blast accused Khwaja Yunus.

A division bench comprising Justices J N Patel and R S Dalvi were informed by Chief Public Prosecutor Satish Borulkar that the DGP had recieved the respective chargesheet against the officers on August 25. It was not for obtaining his sanction and the chargesheet had a letter enclosed with it. The letter said the CID did not have a legal advisor at that point of time and needed the document to be examined for it's legality status, Mr Borulkar said.

The DGP, therefore forwarded the documents to the law department where it has remained pending till date, he explained.

The Court directed Dr Pasricha to study the respective documents and if satisfied with the probe, grant his sanction for suitable action to be initiated against the officers concerned within four weeks.

Of the 14 officers, eight had been suspended. They are Praful Bhosle, Rajaram Vhanmane, Hemant Desai, Sachin Vaze, Ashok Khot, Rajendra Tiwari, Sunil Desai and Rajaram Nikam, while the others have been transferred.

Ambadas Pote was transferred to Nanded while Rajendra Joshi to Pune.

Arun Borde was transferred to Buldhana, Dattatrey Joshi to Nasik (rural), Narhari Birmule to Raigad and Mangesh Mahajan to Nashik, after the court order of October 17, the DGP added.

According to the DGP's affidavit, there were several other officers other than these on the list of the CID, who came under suspicion. These included PSI Daya Nayak. Inspector Pradeep Sharma was transferred to Amravati, Prakash Patil to Nanded, Nimbhaji Yadav to Hingoli, and Dinakr Mohite to Nagpur.

The court was hearing a petition filed by Yunus' mother, Aasiya, claiming a compensation of Rs 20 lakh for the custodial death of her son.

The court has asked the state to consider some compensation as interim relief for Aasiya within the next four weeks.
