HC directs to lodge FIR in prisoner death case
Allahabad, Oct 10 (UNI) Allahabd High Court today directed to lodge an FIR regarding the death of an undertrial prisoner, who was brutally beaten inside Banda district jail.
The court directed immediate investigaation by competent police officer and directed the IG, Banda to entrust the investigation in this case to a competent police officer not below the rank of Deputy Superintendent of Police (DSP).
The division bench comprising Justices R C Dubey and V D Chaturvedi passed this order on a criminal petition filed by Aneesa, wife of deceased Mannu Shah.
The deceased, who was lodged in Banda jail under the NDPS Act, was allegedly beaten inside the jail. Later, when Shah was rushed to hospital, he was declared brought dead.
Despite the application of the deceased's father, the FIR was not registered by the police. Later, his wife filed the petition in the court.
The court issued direction for lodging an FIR after considering the post-mortem report, which indicated the presence of wounds on Shah's body.
Police has been directed to proceed with the investigation in accordance with law. The court would hear the case on November 8.
