Bar council opposes newly passed RPASA Act
Jaipur, Oct 10 (UNI) The Bar Council of Rajasthan has opposed some of the provisions of the newly passed Rajasthan Prevention of Anti Social Activities Act 2006 as 'draconian'.
The council urged the Vasundhara Raje Government to reconsider a provision of the bill which disallows a booked person under the Act to get the services of a lawyer.
Bar Council Chairman Jagmal Singh Chaudhary said the restriction on the appearance of lawyers on behalf of the accused under the Act is unconstituional and goes against the provisons of the Advocates Act 1961. He said it was a denial of legal protection to an accused as everyone has the right to take the services of a lawyer.
He said the Act forbids the accused or the detainee from the taking services of a lawyer even while district magistrate was authorised to refer the case within seven days to a judicial board of serving or retired judges.
