Nepal Maoist leader writ dismissed, HCP closed

Chennai, Sep 28 (UNI) The Madras High Court today dismissed a writ petition and closed the Habeas Corpus Petition (HCP) relating to Nepali Maoist Leader Chandra Prakash Gajurel.

A Division Bench comprising Mr Justice P D Dinakaran and Mr Justice M Thanikachalam dismissed the writ petition filed by Mr Gajurel in 2003 seeking a direction to the Union Government not to deport him to Nepal without following the procedure prescribed under the Extradition Act, 1962.

Pointing out the specific stand taken by the Centre that there was no request for extradition under Section 4 of the Extradition Act and the criminal case ended in conviction and the sentence imposed on him was also completed, the Bench said, adding the writ petition was devoid of merit.

However, the Bench observed if and when any request was made for extradition, it goes without saying that the Union government should adhere to the procedure under the Extradition Act and pass appropriate oders.
