HC transfers dowry death case to CBCID

Chennai, Sep 21 (UNI) Madras High Court today transferred to CBCID, the investigation into a dowry death case in Erode District.

Mr Justice R Raghupathy ordered the transfer of investigation to CBCID on a petition filed by R Doraisamy, father of the deceased Kalaiselvi.

In his order, the judge said as the accused was a subordinate to the Investigating Officer and in view of the facts and circumstances, the transfer of investigation was ordered as prayed for.

Accordingly, Sub-Inspector, Perunthurai Police Station was directed to hand over all the case diaries to Superintendent of Police, Erode District, to facilitate the transfer of investigation to a competent officer in CBCID not below the rank of DSP, the judge added.

Mr Doraisamy's daughter Kalaiselvi was married to Gnanasekaran, who happened to be a head constable under Sub-Inspector, Perunthurai Police Station.

The petitioner contended that Gnanasekaran, an alcoholic used to demand dowry and physically tortured his daughter following which she sustained injuries.

On June 29, 2006, his son Chandrasekaran had met Kalaiselvi at 0930 hrs and she informed that her husband had quarrelled with her.

But at 1200 hrs, information reached Mr Doraisamy that his daughter Kalaiselvi died. When he rushed he saw her daughter's body with injuries. Hence, he lodged a complaint with the police. Though the complaint was made for offences under section 302 (murder), the police registered a case under section 498 A (dowry harassment) and section 306 (Abetment of Suicide) of IPC, to protect the accused, who happened to be the Subordinate of the SI, he alleged.

He did not discharge his duty as Investigation Officer as required under the provisions of law, the investigation may be transferred to CBCID, the petitioner prayed.
