HC directive to UP over pending investigations
Allahabad, Sep 19 (UNI) Allahabad High Court again directed the Uttar Pradesh government and others today to make serious efforts to comply with earlier directions passed by it on August 21, 2006.
A division bench comprising Justices Imtiyaz Murtaza and Amar Saran had directed UP to take immediate steps to arrest the accused wanted in grave cognizable cases for a long period of time.
The bench had restrained for future transfer of investigation to the CB-CID in a routine manner or at the direction of the chief minister or other authorities, except in accordance with the government order or the HC decisions.
In compliance of the order, the DGP had on September 8 issued an order to all SSPs/SPs with a copy to DG CB-CID, additional DGP, DGP (Railways), all zonal IGs and others for strict compliance of the HC directives.
The court has directed for speedy conclusion of pending probes, effecting arrests and ensuring in future no routine transfers to CB-CID are done at the behest of any authority.
The court has directed that district level officials whose opinion is sought for the transfer of investigation, exercises his mechanical 'no objection' opinion to please political functionaries.
The court sought clarification from the respondents for not arresting the different categories of the total number of 1,918 accused against whom investigations are pending.
The judges have directed for further progress report of 1,079 investigations pending with the CB-CID.
There are 100 investigations pending for over 10 years and 167 investigations pending for 5-10 years must now be concluded within three months, if possible.
The court will hear the case on November 16, 2006.
