High Court reprive for Dalmiya in BCCI case

Kolkata, Sep 7 (UNI) Former BCCI Chief Jagmohan Dalmiya today received a respite after Calcutta High Court extended the time for submitting his explanation to the Board till October three regarding the alleged misappropriation of 1996 World Cup funds.

Justice Pranab Kumar Deb, rejecting a lower court order, directed that Mr Dalmiya would have to submit his explanation before the BCCI by October three and appear before the Disciplinary Committee by October 10, if required.

Mr Dalmiya claimed that several copies of documents supplied to him by the BCCI were illegible and had moved a revision application before the high court against a city court order that rejected his application seeking fresh copies of documents and extension of time.

Mr Dalmiya, in his appeal, said 64 copies of bank documents were illegible and prayed for direction to the BCCI management for supplying fresh copies and sought an extension of time.

BCCI counsels S K Kapoor and S K Bajoria submitted that the board was supplied with these photo copies by the bank and as such unable to supply better copies and they also contended that the 64 papers Mr Dalmiya was talking about were not required for the allegations levelled against him.

Justice Deb noted the BCCI contention that the illegible documents would not be relied upon in its Disciplinary Committee proceedings and directed him to reply by October three.

The City Civil Court chief judge had last week refused to accept Dalmiya's contention that copies of the documents were illegible, observing that the BCCI had stated that the documents supplied to Dalmiya here on August 26 would not be relied upon in its Disciplinary Committee proceedings against him and as such producing fresh copies or extending the date for submitting his reply were not necessary.

Mr Dalmiya, at present the Cricket Association of Bengal (CAB) president, was required to file his explanation by tomorrow as per the lower court's order.
