HC stays government ban on sale of Pepsi
Bangalore, Sep 4 (UNI) The Karnataka High Court today issued a stay on the Karnataka government order banning sale and distribution of softdrinks manufacturered by Pepsico in public places.
Justice Shylender Kumar, granted an interim stay to the government order of August 14, which prohibited sale of soft drinks (forumulated beverages) in public places like government offices and hospitals.
However, the court did not touch upon the government order regarding ban on sale of soft drinks within 100 feet of schools and colleges.
In a petition filed against Pepsico India Holdings challenging the Government order, the company contended that there was no prescribed limit -- either low or higher rate of pesticide residue.
The State government had sent the samples of Pepsi and other soft drinks to CFTRI, Mysore and is awaiting its report.
The Court directed the government to collect a good number of samples at randum from all over the State and test it and analyse and report to the court.
The Court also directed the Pepsiso India Holdings to file a report regarding the contents and ingredients of their beverage.
However, the Counsel for the company informed the Judge that it may not be proper since the matter is seized in the Supreme Court and it may be sub judice.
Further hearing on the case was posted for September 25.
