Sikkim govt compulsory retirement of district and Sessions judge

Gangtok, Sep 2 (UNI) The Sikkim government has ordered retirement of a District and Sessions Judge (P C Act) Namchi, B C Sharma for his refusal to deliver judgement in disproportionate asset case filed against former Chief Minister Nar Bahadur Bhandari, on the designated day after completing the hearing.

''On the recommendations of the High Court of Sikkim, B C Sharma, District and Sessions Judge (South and West), Namchi is hereby compulsorily retired from service with immediate effect in pubic interest in terms of Rule 99(1) of the Sikkim government service Rule, 1974 duly giving him three months salary in lieu of three months notice,'' the notice said.

This is for the first time in the judicial history of the state that a district and sessions judge has been ordered to retire for refusing to deliver the verdict.

However, earlier Uday P Sharma, a district and sessions judge and P Wangdi Palzor, a civil judge, were sacked for dereliction of duty.

CBI had chargesheeted and registered a case against Mr Bhandari in 1997 under the Prevention of Corruption Act for amassing assets worth more than Rs one crore, disproportionate to his known sources of income during his chief ministership from 1985 to 1995.

The case was later transferred from the court of Special judge East Sikkim at Gangtok to Special Judge at Namchi for trial on the order of the High Court.
