Petition in HC filed seeking to register case against Vaiko

Chennai, Sep 1 (UNI) A petition was today filed in Madras High Court, seeking a direction to the police to register a case against Marumalarchi Dravida Munnetra Kazhagam (MDMK) General Secretary Vaiko for allegedly supporting the banned organisation LTTE and provocative speech to incite violence at a public meeting here on August 21, 2006.

The petition filed by K Paul, a member of the Indian National Congress, is likely to come up for hearing on September four.

In his petition, Paul submitted that he had been to Saravana Stores in T.Nagar on August 21. There was a public meeting in Mambalam where Vaiko was addressing a gathering with provocative speech to incite violence. During the speech, Vaiko had warned not to create a Kashmir within Tamil Nadu and openly praised Prabhakaran, the leader of LTTE, a proclaimed offender and prime accused in Rajiv Gandhi assassination case.

The MDMK leader also openly came in support of Manimaran, District Secretary, MDMK, who was recently arrested for speaking that all the youth belonging to Tamil Nadu would take up AK-47 rifles.

Mr Paul, in his petition said he lodged a complaint before the Inspector of Police, Mambalam Police Station on August 23. Since there was no action on the complaint, he also sent a representation to Commissioner of Police, Chennai on August 28. Even thereafter there was no response from the police. Hence the present petition, he added.

He contended that his complaint has expressly made out the ingredients of the offences under section 124-A (sedition), 153, 153-B and 505 of IPC.

The police ought to have registered a case since the offences are cognizable in nature. The police had failed to even register a case for the reasons best known to them, which was in violation of the Code of Criminal Procedure and the Police Standing Orders, he added.
