Hearing on Jaya's petition in IT cases adjourned to Sep 13

Chennai, Sep 1 (UNI) Madras High Court today adjourned to September 13, further hearing on a revision petition and a writ petition filed by former Tamil Nadu Chief Minister J Jayalalithaa in connection with income tax cases.

When the revision petition, against an order of the lower court, refusing to discharge her from the income tax cases and the writ petition, challenging the constitutional validity of section 278 E of the Income Tax Act, filed by Jayalalithaa, came up for hearing before Ms Justice Prabha Sridevan, Additional Solicitor General V T Gopalan submitted that following a Supreme Court order, the lower court disposed of the discharge petition.

When the Magistrate decided to frame charges, the revision petition was filed. Hence the Income Tax Department has filed a petition before the apex court, seeking clarification. Since this petition is coming up for hearing on September 4, the hearing may be adjourned, Mr Gopalan contended.

Mr N Jyothi, appearing for Ms Jayalalithaa, submitted that these petitions were filed a month back. When these petitions came up for hearing last time, Justice K Raviraja Pandian expressed his unwillingness to hear the matter and directed the Registry to post before the Chief Justice for posting it before some other judge. At that time, the Income Tax Department filed a bunch of papers along with counter affidavit. It will take time to go through the counter and file reply. Moreover, only yesterday, the department had filed a SLP before the apex court. The attempt of the department was only to pre-empt any interim order. He also sought time to file his reply to the counter.

Following this, the judge adjourned further hearing to September 13.
