HC gives 15 days to PNB to shift its branch from illegal building

New Delhi, Sep 1 (UNI) While showing leniency in public interest, the Delhi High Court today stayed the demolition of an unauthorised building at Mehrauli in South Delhi for 15 days and directed the Punjab National Bank(PNB) to shift its branch from the premises.

A division bench headed by acting Chief Justice Vijender Jain directed the Delhi Development Authority(DDA) to stay the demolition of the building for 15 days for allowing the bank authorities to shift its branch.

DDA Counsel Rajiv Bansal submitted that the building owned by S D Singh was constructed without getting the plan sanctioned by the authorities.

The DDA had sent the demolition squad on August 28 to carry out the demolition after serving the notice on May 24, said Mr Bansal.

In a petition, the PNB requested that the order of the DDA should be quashed or kept in abeyance for at least a year for shifting the branch to another premises in the locality.

The action of the DDA in issuing the order of demolition on May 24 was in contravention with the Delhi Law (Special Provision) Act 2006 and the building was constructed before the cut-off date of January 1, 2006, said Senior Counsel Rajiv Nayar appearing for the PNB.

The Bank, which is operating a branch in the area since 1978, has 13,000 account holders, 2500 pensioners, 500 lockers, 2000 ATM card holders with Rs 48 crore account fund and Rs 4.5 crore loan advance.

The bank was shifted to the present premises on March 31, 2006 after scrutinising all documents, said the petition.
