Govt to consult legal experts on regularisation ruling

Chennai, Aug 31 (UNI) Tamil Nadu Chief Minister M Karunanidhi told the state Assembly today that the Government would consult legal experts on the future course of action in the wake of the Supreme Court upholding Madras High Court's order to quash regularisation of buildings constructed in violation of rules in Chennai city.

Replying to a special mention raised by Congress Whip Peter Alphonse, he said the issue was very ''important and complicated.'' There were many instances of the courts striking down legislations enacted in the Assemblies, he said.

Mr Karunanidi said the Government would take steps to stall the SC order, if possible, after consultation with legal experts.

Earlier, Mr Alphonse said the Government should verify whether the High Court had transgressed the rights of the State Government and the Assembly by forming a monitoring committee to inspect all buildings which had more than four floors.

He said the Chennai Metropolitan Development Authority (CMDA) was a statutory body which was authorised to regularise buildings constructed in the city.

The High Court, which struck down the regularisation scheme introduced in 1999 and amended and extended for three consecutive years thereafter, should have asked the CMDA to form the committee instead of taking over the rights for itself, he said.
