Pepsi challenges K'taka Govt's ban on sale of soft drinks

Bangalore, Aug 30 (UNI) Manufacturers of Pepsi have challenged the Karnataka Government's action of banning the sale of aerated drinks in educational institutions, hospitals, government offices and temple lands in the State.

M/s Pepsico India Holdings (P) Ltd and Pepsi Food (P) Ltd, Punjab, filed a petition in the High Court, challenging the ban under the provisions of the Prevention of Food Adulteration Act and questioned the relevant provisions of the Act.

The petitioners contended that they had been duly licensed by the Union Government and the State had no jurisdiction to issue the impugned order.

When the case came up before Justice D V Shylendrakumar today, Mr Iqbal Chagla of the Mumbai Bar argued for the petitioners and the State was represented by Advocate General Uday Holla. The arguments remained incomplete today and would be resumed tomorrow.

It may be recalled here that the State Government had banned the sale of the carbonated drinks after laboratory tests conducted by the Government revealed that the drinks contained pesticides beyond the permissible level. The Government had also filed a case against the manufacturers of Coca Cola in this regard.
