Petition to cancel bail of SP MLA and his father

Kishanganj, Aug 19 (UNI) A petition has recently been moved in Patna High Court for cancellation of the bail of Samajwadi Party (SP) leader in the Bihar Assembly and Thakurganj MLA Gopal Kumar Agrawal and his father Tara Chand Dhanuka for misleading the court in connection with a murder case.

The father-son duo along with five others had already been chragesheeted in a murder case at Lungerduba village under Galgatia police station, according to lawyer Khaliquzzama today.

Police said the father-son duo along with five others were charged with brutally killing a tutor on the night of Aug 5, 2002, and were arrested then in this connection.

Police after due investigation submitted chargesheet against all the seven accused in November the same year. The chargesheet was filed in the court of Chief Judicial Magistrate.

Ilyas, younger brother of the killed tutor Moimuddin, had lodged a case against them at Galgalia police station.

However, Patna High Court granted bail to father and son on medical ground in the same year. While father Tarachand claimed he was suffering from cancer, Gopal Agarwal said he was suffering from heart ailments.

The court while granting them bail on medical ground also ordered constitution of a medical board and said if the medical board found something adverse, their bails would automatically stand cancelled, the lawyer averred.

The medical team, constituted by the local Chief Judicial Magistrate court at the direction of Patna High Court, however, did not find any malignancy in the father nor did they come across any symptom of heart ailment in the son.

When the bails were not cancelled and the accused were not put in the custody, the younger brother of the victim moved Patna High Court for cancellation of bails.
