New Delhi, Aug 12 (UNI) The CBI in its report filed in the Supreme Court has said it cannot confirm whether Mani Kumar Subba, the Congress MP from Tezpur, Asom, is the same Mani Raj Limboo, who allegedly escpaed from the jail in Nepal where he was serving sentence for the murder of his sister.

According to the CBI, authorities in Nepal were not cooperating in giving relevant details of the alleged accused and even the authorities in Sikkim, from where the lottery king is reported to have entered India, have also not been able to provide much details.

Under these circumstances, the investigating agency cannot say for sure whether the MP is the same person who had escaped from the jail in Himalayan Kingdom, the report added.

The report was filed in the apex court early this week, after it passed orders during the hearing of a writ petition filed by Vishwanath Singh seeking directions to the respondents to set-aside his candidature saying he was an absconder and has allegedly changed his identity to escape detection.

Mr Subba in his counter affidavit had denied the allegations made by the petitioner calling it politically motivated and also challenged the locus of the petitioner to file such a PIL.

According to the petitioner, the MP is liable to be prosecuted for the offence of impersonation and also for filing a false affidavit before the returning officer about his identity and got himself enrolled as voter fraudulently.
