HC confirms death sentence for rape, murder of 11-year-old
Mumbai, Aug 11 (UNI) Bombay High Court today confirmed the death penalty awarded by the Sewree Session Court in January this year to an accused for rape and murder of an eleven-year-old girl in Mumbai.
Bhagyashree Nakashe (11), a resident of Agripada in South Central Mumbai, was asked to get some provisions from a general store at 2300 hrs by her mother in November 2004. The girl went to the shop with her brother Santosh (7) but did not return until 2330 hrs.
Santosh returned alone and when asked about her, said she had gone to have Chinese food with the accused Arjun Laxman Jogadiya alias Abdul Rehman Shaikh (35), a mechanic in the neighbourhood known to the family.
A division bench comprising Justices D G Deshpande and S A Bobde confirmed the death sentence after the rape and murder charges were established with the evidence like the girl's bloodstains on the accused clothes and on the testimony of the girl's brother.
