97 unauthorised structures not under purview of Delhi Act: BJP
New Delhi, Aug 11 (UNI) A day after the Supreme Court partly stayed the operation of the Delhi laws (special provisions) Act, 2006, the opposition BJP in the MCD today termed the Act as full of lacunae and ambiguities due to which it was unlikely to provide relief to a majority of people in the national capital.
''The Delhi laws (special provisions) Act, 2006, notified by the Centre on May 19 to put a year's moratorium on removal of unauthorised constructions as well the sealing of commercial premises operating from residential areas, contains certain legal lacunae and ambiguities due to which it is likely to provide relief for only three per cent of the unauthorised developments in Delhi,''BJP member in the MCD and a member of the Standing Committee Vijender Gupta told reporters here.
''Almost 97 per cent of unauthorised constructions in Delhi have not been given relief under the Delhi Laws (Provisions) Act,'' he said.
In a letter written to Union Minister for Urban Development Jaipal Reddy, Mr Gupta said the Act had no protection for any unauthorised construction raised without any sanctioned plan.
''If we go though the notification, it is evident that only a small segment of construction "construction beyond sanction plan", is protected by this act and not other constructions,''the letter said.
''Various flaws and ambiguities in the notification show that the Central government is not serious in protecting the interests of people of Delhi,''Mr Gupta told reporters.
Mr Gupta urged the Minister that to save the citizens of Delhi from drastic action of demolition of unauthorised constructions and banning of commercial activities in residential areas, it was imperative that the Centre should suitably amend the Master Plan and implement it immediately.
