Court soughts details of the criminal cases against Md Shahabuddin
Patna, Aug 9 (UNI) Patna High court today directed the state government to inform it about the number of criminal cases pending against the incarcerated RJD MP Md Shahabuddin at time of contesting the Lok Sabha elections in 2004 and at present.
While hearing a bail petition a single bench of the court of justice Naveen Sinha directed the government to file the related affidavit within three weeks from now. The court also asked the government to inform about the status of the cases.
The court was hearing the bail application of Md Shahabuddin in connection with a criminal case related to misleading the Election Commission by furnishing false affidavit regarding number of criminal cases lodged against him.
In the affidavit filed before the returning officer cum district magistrate of Siwan on April 5, 2004 Md Shahabuddin had mentioned about 19 criminal cases pending against him.
Later an FIR was filed against Md Shahabuddin in Siwan for misleading and cheating the election commission. The FIR stated that 34 cases were pending against Md Shahabuddin.
Opposing the bail application in the court during the day, the Additional Public prosecutor S Dayal said Md Shahabudding had cheated the Election Commission.
Defence counsel Y V Giri pleaded that his client had no intention to mislead the Election Commission and had mentioned the number of criminal cases as 19, as they were in the stage of trial.
He further argued that other cases were just under investigation at the time of filing the nomination for the Lok Sabha elections in 2004.
By the direction of the same court, Md Shahabuddin was recently shifted to Delhi from Siwan jail for his spinal problems treatment at AIIMS.
