Suit of Arjun Singh's brother dismissed

Allahabad, Aug 3 (UNI) Allahabad High Court has dismissed a suit filed by the brother of union HRD minister Arjun Singh and two others to occupy the properties of Maharaja Rewa, situated in Madhya Pradesh, Maharashtra and Allahabad.

The minister's brother Sajjan Singh, H S Srivastava and Ajai Singh had filed the suit for obtaining probate of the properties of Maharaja Rewa on the basis of a will.

The court dismissed the suit imposing Rs 5,000 cost upon the plaintiff.

Justice S Ambwani dismissed the suit on the ground the plaintiffs had failed to prove the genuineness of the will alleged to have been executed in their favour.

The suit was opposed by the Maharaja's widow Maharani Praveen Kumari and son Pushpraj Singh.

Dismissing the case, the HC held the will alleged to have been executed by Maharaja Rewa Martand Singh Judeo in favour of Sajjan and two others, was not duly and validly executed by the Maharaja.

The court observed, ''it is not proved that he was in sound and disposing state of mind to understand and nature, contents and effect of the alleged will of January 5, 1993 on date alleged to have been executed. The will was not prepared on his instruction and appear to be prepared as a result of a fradulent act of the executors and other interested persons in maneuvering circumstances.''
