K'taka Govt official's petition against transfer rejected
Bangalore, Aug 3 (UNI) The Karnataka High Court today rejected at the preliminary stage itself, without issuing notice, a writ petition filed by the Agriculture and Water Development Joint Director in Gulbarga to quash his transfer order.
Chief Justice Cyriac Joseph and Mr Justice N K Patil slapped costs of Rs 25,000 on him, observing that he was ''resorting to abuse of process of court.'' The petitioner, Mr Malla Reddy, had been transferred from Gulbarga, where he was working since December 2004, to Gadag. As his representation to retain him in the present post considering his retirement on August 31 did not yield the desired result, he approached the Karnataka Administrative Tribunal for relief. The KAT granted a stay on the transfer order and asked him to proceed on leave for ten days. The transfer order was then modified and he was posted at CADA of Bheemarayana Gudi in Shahpur taluk. After joining duty at the new place, he proceeded on leave and approached the KAT and High Court.
