Information Commissioner's appointment illegal- Mr Lama

Gangtok, July 30 (UNI) Sikkim leader of opposition Acharya Tshering Lama has dubbed the decision to appoint D K Gazmer as state's Chief Information Commissioner (CIC) 'unconstitutional' and urged the Governor not to be a party to it.

Mr Lama, the lone Congress MLA representing the Sangh constituency in the 32-member house, in a memorandum to the Governor yesterday said the appointment was violative of the clause (3) section 15 of the Right to Information Act.

He said clause (3) of the Act clearly said the Chief Minister as the Chairperson of the three-member recommending committee, must take into consideration the views of the leader of Opposition while appointing the state CIC.

But the decision to appoint Mr Gazer as the CIC was taken by the Chief Minister and his cabinet colleague, a member nominated by the Chief Minister to the Committee, exparte ignoring '' my views'', Mr Lama alleged.

The leader of the opposition alleged that the appointment of Mr Gazmer as the CIC was '' inconsistent and violated clause (3) of section 15 of the RTI Act.

He said he would not attend the swearing-in-ceremony scheduled to be held on August one in the Rajbhawan to administer the oath of office to Mr Gazmer as a mark of protest.
