City Civil court reserves judgement on independent observer
Kolkata, July 21 (UNI) The City Civil court today reserved its judgement till July 24 on a prayer, made by the anti-Dalmiya faction for appointing an independent observer to the July 30 Cricket Association of Bengal (CAB) polls.
Chief Judicial Magistrate (CJM) P K Sirkar heard the petition, made by Aryans assistant secretary Samar Paul for appointment of independent observer to the polls without which they feared that elections might not be free and fair.
While counsel for petitioners Jayanta Mitra presented the case, the CJM said the court could appoint two observers but the final decision would be taken after seeking opinion of both parties.
Under such circumstances he reservd the verdict till Monday.
Meanwhile, a division bench of Calcutta high court yesterday refused to admit an application made by the anti-Dalmiya faction in the CAB seeking direction to a lower court for expeditious hearing of its suit for appointment of an independent observer for the coming polls.
The case was heard by Justice Prabir Kumar Samanta after another bench chaired by Justice Pranab Chattopadhyay released the matter on personal grounds.
A two-judge bench, headed by Justice P K Samanta, heard the case in which applicant and assistant Secretary of Aryans Club and leader of the dissident group Samar Pal's counsel Debanjan Mondal and team requested for the high court's intervention in passing an interim order for speedy disposal of the case.
But Justice Samanta after taking note of the situation, denied to admit the case and sent it back to the lower court directing it to hear the petition today.
