S Dinajpur PP continues his duty illegally: Lawyer
Balurghat, July 14 (UNI) The Public Prosecutor of South Dinajpur is 'illegally' holding the post since the last 12 years, according to a petition filed by Balurghat Court Lawyer Md Amjad Ali.
South Dinajpur Public Prosecutor (PP) Binoy Krishna Mohanta had continued in the post since March 1993. Legally his tenure had ended on March 16, 1994. Even after his tenure ended, he is still continuing his service, the petition stated.
As per the Indian Constitution, District Sessions Judge makes a panel of PPs after consulting District Magistrates.
The DM then sends the panel to Legal Remembrance (LR) Department through the Divisional Commissioner for approval after which it is implemented.
Mr Mohanta's name was not included in the panel in 1997, 2000 and 2004.
Mr Ali questioned how Mr Mohanta could continue as a PP when his term expired in 1994.
Mr Ali said in the petition, ''On September 10, 2002, the LR ordered extension of the duty of Binoy Krishna Mohanta from 16.03.97 to 16.03.2001 for four years. On July 2, 2003, the LR again ordered that Binoy Krishna Mohanta would act as a District PP. This is violation of the Indian Constitution,'' he contended.
