SC gives green signal to running evening law colleges
New Delhi, July 13 (UNI) The Supreme Court has given the green signal for running evening law colleges by quashing the Bar Council of India (BCI) resolution barring the evening law colleges as ultra vires of the Advocates Act, 1961.
A bench of Justices K G Balakrishnan, Tarun Chatterjee and D K Jain held yesterday that there had not been effective consultation by the BCI with state Bar Councils and the universities in the matter.
The apex court upheld the Punjab and Haryana high court order dated September 29, 2000 declaring amended rules 2 (i) of Bar Council Rules as violative of the Advocates Act,1961.
The apex court dismissed the appeal filed by BCI against the high court judgment.
The court also cleared the decks for disposal of applications for enrolment as advocates pending before various state Bar Councils by those who have studied law through evening law colleges.
