HC notice to Delhi Govt, Centre on Delhi building bye-laws

New Delhi, July 13 (UNI) The Delhi High Court has asked the Central Government and the Delhi Government to explain why stay shouldn't be granted on enforcement and operation of the Delhi Building bye-laws of 1983.

The division bench headed by Acting Chief Justice Vijendra Jain today issued notices to the Union Home Ministry, Urban Development ministry, the DDA, MCD, NDMC, and the Government of NCT to file their replies within 4 weeks.

The petition, moved by society for safe structures and argued by Anil Aggrawal, seeking the stay submitted that the building bye-laws are fountain head of corruption.

The bye-laws of 1983 were prepared by the DDA for application in the development areas under its jurisdiction, keeping the specific requirement and demands of further development, the petition further specified.

However, it was all adopted by the Centre in the areas specifically excluded under bye-law in Rohini and Resettlement colonies (Lajpat Nagar, Patel Nagar, Tilak Nagar etc).

Requirements and provisions laid down in bye-laws which are specific only for the development can't be fulfilled by the residents/owners in these non-development areas, Anil Aggrawal submitted.
