College Act in conformity with Constitution: Kerala Govt

Kochi, July 11 (UNI) The Kerala Government today filed a statement before the High Court justifying the Kerala Professional College (Prohibition of Capitation Fees, Regulation of Admission) Act 2006.

According to the Government, the Act was in conformity with the Constitution of India as well as the judgements of the Supreme Court.

The Government submitted that the Act was enacted in the larger interest of the public, especially the student community and was aimed at ensuring admission to private unaided professional colleges in a fair, transparent and non-exploitative manner.

It also submitted that in the T M A Pai case the Supreme Court had reiterated the presumption in favour of the Act passed by a legislature, unless it is shown that the same is contrary to public order and national interest.

The Government filed the statement on the writ petition filed by the Kerala Self-Financing Engineering College Managements Association and others challenging the validity of the Act. The Court will consider the matter tomorrow.
