CJM Court directs CBI to further probe Kiliroor case

Kochi, Jul 10 (UNI) The Ernakulam Chief Judicial Magistrate Court today returned the chargesheet in the Kiliroor sex racket case to the CBI with directions for further investigations.

On going through the case diary, Magistrate P D Sarangdharan observed that the CBI had conducted only a formal investigation in the case and there was no earnest effort to find out the truth.

The court was of the view that the CBI had not conducted a proper enquiry into the cause of the death of Sari, the sex racket victim.

The CBI report indicated that the blood sample of the victim contained 5.25 mg of copper per 100 ml of blood. This quantity of copper is too excessive and the doctors had no satisfactory reason or explanation for it.

After verification of the statement of the doctors, the court found that the investigatiing officer had not put proper questions to the doctors in this aspect.

The medical board opined that the treatment given to the victim was the best available. There was no fault or deficiency in the treatment.

The doctors have not opined that the excessive quantity of copper found in the blood sample of the deceased victim was due to any medicine administered to her or due to any complications developed during the course of treatment. So the presence of excessive quantity of copper in the blood may be due to some other factors, the court opined.

The CJM court considred the question of lapses in the CBI investigation on a petition filed by the 'Janadhipathya Vanitha Sanghatana'. But the court dismissed their petition for further investigation after holding that the role of a third party in a criminal proceeding was very limited.

The CBI had submitted the final report in the case against nine persons for offences including gang rape.
