Dalmiya threatens legal action against Niranjan Shah
Kolkata, July 2 (UNI) CAB President Jagmohan Dalmiya has sought unconditional apology from BCCI threatening legal action if it was not complied with regarding the missive sent by the board suspending all payments to the state association.
In a letter to BCCI secreatry Niranjan Shah, Mr Dalmiya said, ''Without prejudice and reserving all my accrued rights and entitlements, you are hereby called upon to withdraw letter under reference and tender an unconditional apology forthwith in the event of non-compliance, appropriate necessary steps as I may legally advice, would be initiated against you personally at your peril and consequences.'' The letter further stated, ''the malafide, vindictive and malicious intention of the BCCI is apparent on the face of the contents of your letter dated June 29, 2006.'' ''It is utterly false and frivolous to allege by wilful suppression of facts that I have been provided with inspection of the records of the board on May 5, 2006 in Chennai. The minutes also record the balance of the documents would be made ready and available for further inspection and copies thereof within a fortnight's time from May 5, eventhough I have not received any intimation for further intimation of copies,'' Mr Dalmiya said in the letter.
Mr Dalmiya further said, ''BCCI has been held to be discharging public functions and has been ruled by the honourable apex court that it should only act within the dourcorners of memorandum and rules and regulations and exercise its powers in a fair amd honest manner, but it is also bound to follow the doctrine of fairness and good faith in all its activities. BCCI can not act arbitrarity, whimsically and capriciously.'' ''Following the above rules of law if the acts and conduct of BCCI, including the contents of your letter dated June 29, are considered, it would explicitly clear that BCCI is following the doctrines of unfairness and bad faith apart from acting arbitrarily and capriciously,'' the letter said.
In a letter to the CAB on June 29, Board secretary Niranjan Shah informed the state association that the board has decided to debit to the CAB, Rs 40 crore its president Dalmiya failed to furnish details of despite a notice being served to him on April 15.
