Advocate General to clarify on reservations before HC

Chennai, Jun 26 (UNI) Advocate General R Viduthalai today told Madras High Court he would clarify and inform the court on whether minority institutions should follow rule of reservation to admit students under management quota in self financing engineering colleges.

When the petititon by Consortium of Professional, Arts and Sciences colleges, challenging an order of Justice S S Subramani Committee, directing self-financing colleges to follow single window system and rule of reservation in admission of students under management quota, came up for hearing before Mr Justice K Raviraja Pandian, following a plea from Senior Counsel N R Chandran, Mr Viduthalai made the submission.

When the case came up for hearing last time, the Consortium and the State Government arrived at a consensus. While the former voluntarily agreed to surrender 65 per cent of seats in non-minority institutions and 50 per cent in minority institutions to the state government, Mr Viduthalai had stated that the government would not enforce Justice S S Subramani's order for the academic year 2006-07.

The judge then directed both parties to file affidavits.

Accordingly, both parties today filed affidavits.

Pointing out averments in the affidavit filed by the state that self-financing engineering colleges had to make admissions based on marks obtained by students in Plus Two and also marks got by them in the Common Entrance Test by following the rule of reservation, Mr Chandran sought clarification on which kind of CET, the institutions had to follow and rule of reservation.

Mr Viduthalai said the institutions could follow either the CET conducted by Anna University or All India Engineering Entrance Examination, or CET conducted by the Consortium.

On rule of reservation, he said non-minority institutions should follow rule of reservation. Minority Institutions, if they admitted minority students, the government had no objections. If they admitted non-minority students, they had to follow rule of reservation.

He added he was authorised by the Committee to state that it did not want to be a party, if any order was likely to be passed by the court. The consensus was between government and the Consortium.

Mr Chandran said minority institutions need not follow rule of reservation under management quota. The court also recognised the right given to institutions to admit non-minority students in minority institutions.

Mr Viduthalai said he would clarify with the government and inform the court tomorrow. Following this, the judge adjourned the hearing to tomorrow.
