Civil services unsuccessful candidate appeals in SC

New Delhi, June 25 (UNI) A civil services aspirant, whose name was excluded from the list of successful candidates in 2004 after the UPSC allegedly deducted about 90 marks from five out of seven papers, has prayed to the Supreme Court to review its own May 2006 order dismissing his appeal against the Delhi High Court order.

The candidate, Neel Ratan, had cleared both the preliminary as well as main civil services examinations for the year and received a call letter for the interview held on April 4, 2005.

The final result was published on May 11, 2005 and his name was missing from the list. The High Court noticed that notings on the answer-sheets of the petitioner were made in May and June, 2005, much after the alleged moderation having been done and it was also admitted by the UPSC that 57 marks were deducted from the answersheets of the five papers of the petitioner without any approval of the head-examiner which is mandatory. The respondents did not disclose whether moderation was applicable in the case of the petitioner and no records for the verification of moderation were produced.

According to the petitioner, 90 marks were deducted from his answersheets and they were not re-evaluated despite his representations.

The High Court finally dismissed his petition challenging his exclusion from the final list of successful candidates.The two judge bench of the High Court also dismissed his appeal vide impugned order dated April 21, 2006.

The apex court dismissed his Special Leave petition vide order dated May 22, 2006.
