SC dismisses petition seeking CBI inquiry in official's death
New Delhi, June 16 (UNI) The Supreme Court today dismissed a petition seeking a CBI inquiry into the alleged murder of Yashvir Singh, Additional Commissioner of Gorakhpur, Uttar Pradesh, who was found dead in his official residence on January 19.
A Bench, comprising Mr Justice Arijit Pasayat and Mr Justice Altamas Kabir, dismissed the petition of Hari Singh, father of the deceased, who had alleged that the local police in connivance with in laws of the deceased were trying to convert the case of murder into a case of suicide just to shield the real culprit.
The petitioner had also alleged that he was under constant threat and pressure from the police as well as from some influential people who were inimical to the deceased and no action had been taken by the police against the culprits till date.
The apex court, however, held that the Magistrate has the power to direct the police to investigate the matter as also to take cognizance of the complaint and issue summons to the accused persons, if the complaint discloses a cognizable offence.
The Court relying on earlier judgement held, That a writ petition in such cases is not to be entertained. That being so, this petition is not to be entertained. The writ petition is accordingly dismissed.'' The apex court, however, taking note of the allegations of the petitioner that he is under constant threat by some persons and his life and property are in danger, directed, '' If he seeks any protection, it is the duty of the concerned police officials to provide such security as is warranted in the circumstances in accordance with law''.
