K'taka HC directs SEC not to notify polls to town municipalities

Bangalore, June 13 (UNI) The Karnataka Government today directed the State Election Commission (SEC) and other authorities not to notify the elections to certain town municipalities whose term of office had already expired or about to expire.

The Bench, comprising Chief Justice Cyriac Joseph and Mr Justice N Kumar, issued the direction on a public interest litigation filed by Sindhanoor Town Municipality President T Haumanthappa seeking a direction to the state government, Director of Municipalities and the SEC not to hold elections on the basis of the 1991 Census Report of Population and the constituencies delimited on the population as reported in that year.

The petitioner contended that the authorities were preparing to hold elections to the civic bodies in the state on the basis of the population figures in the earlier census report, when the 2001 report was available.

He pointed out that instead of taking up delimitation of constituencies for single-member wards in view of all the constituencies being made single-member constituencies, the SEC proposed to issue notifications calling for elections on the basis of earlier census report and also the old constituencies.

The petitioner said this proposal was illegal and not valid and sought appropriate directions to the SEC to prepare for delimitation of single-member wards and voters list as per 2001 census figures.

The court adjourned the hearing of the petition to June 16.
