HC grants bail to 'accused', pulls up prosecution

New Delhi, Jun 2 (UNI) The Delhi High Court today allowed anticipatory bail to petitioner, reprimanding the prosecution for forcing a conclusion in absence of any investigation.

The prosecution alleged that Hashmuddin, the petitioner, hatched a conspiracy with a co-accused, Deshraj, and caused themselves grievous injuries so that they could implicate ''two sworn-enemies'' in a case of assault.

"What made you think so? That too without any investigation. Why could they cause such injuries as were fatal? You might have probed the matter to arrive at a conclusion," Justice BD Ahmad asked the prosecution.

The court granted bail to the petitioner Hashmuddin even as his counsel RM Tufail rose to argue.

It was Deshraj, a co-accused, who had lodged an FIR with Seelampur police station on March 9, 2006 accusing Furkan and Deen Mohammad of having shot Hashmuddin in his right chest and assaulted Deshraj with a knife.

However, the prosecution submitted before the court today that the case was just the opposite, adding that Deshraj, original complainant of the FIR, and Hashmuddin were the main accused.

When they added further that Hashmuddin shot himself with a pistol in chest and Deshraj inflicted upon himself injuries with a knife so that that they could pass the blame on their sworn enemies, the court reprimanded the prosecution wondering the basis of such a conclusion.

Languishing in the police custody, Deshraj needs as much medical intervention as Hashmuddin, Mr RM Tufail argued.
