Court seeks gubernatorial sanction in Chief Minister case
Patna, Jun 2 (UNI) A local court today turned down a request for its involvement in obtaining gubernatorial sanction to prosecute Chief Minister Nitish Kumar and his cabinet collegues in a case of alleged abuse of authority and power.
Chief judicial magistrate of Patna Justice Sushma Sinha has directed the complainants to produce sanction order for prosecution to facilitate the court to proceed in the case filed against Bihar Chief minister Nitish Kumar, Deputy Chief Minister Sushil Kumar Modi and 14 other ministers till June 27.
The complainants had stated yesterday that the Bihar Governor had been approached seeking his sanction to prosecute the Chief Minister and his cabinet collegues. They also sought the help of the court to obtain the said sanction.
The court in its order said that it was not the business of the court to obtain prosecution sanction order. The court directed the complainants to file sanction order till the next date fixed and clarified that in the event of failing to do so, necessary order would be passed.
A complaint case was filed against Bihar Chief Minister and his cabinet colllegues for allegedly violating the provisions of reservation roster under the Bihar Reservation of Vacancies in Post and Services Act 1991 in employment of retired military personnel on a contract of one year in Special Auxilary Police (SAP) through a decision of state cabinet.
