HC summons details of cases pending with CB-CID

Allahabad, June 1 (UNI) Allahabad High Court has directed the Uttar Pradesh government to file a detailed counter affidavit by July 13, 2006 indicating the total number of cases, where probes are pending with the CB-CID.

The order was passed by a division bench comprising Justices Imtiyaz Murtaza and Amar Saran in a writ petition filed by Sandeep Kumar Yadav of district Basti.

The number of cases, in which probe is pending (with submission of chargesheet or final report) for a period over 10 yrs, below 10 and 5 yrs, below 5 and over 3 yrs, below 3 and over one yr and below one yr has to be submitted in the court.

The court directed the Uttar Pradesh Principal Secretary (home) to give the details of the number of accused in year wise breakup of categories, who have not been arrested and jailed. The information may be furnished in a tabular form.

The bench also summoned the details about number of cases, which were entrusted to the CB-CID in the last 24 months.

The details of each case must mention the number and crime number and also the date of FIR, sections under penal code or other laws, details of transfer, recommendations for transfer and consent of SSP/SP is also required to be furnished.

The court observed, ''This is a pathetic state of affairs when an accused can have the choice of the investigating agency, which must dance to his tune.'' These orders transferring the investigation at the instance of the accused in a case under section 302 IPC were also in contravention of the apex court directions in Union of India vs W N Chadha, AIR 1993 SC 1082.
