Resident doctors to file separate writ petition in SC
New Delhi, May 31 (UNI) The resident doctors, who have decided to resume their duties from tomorrow in view of the Supreme Court's directions, would file a separate writ petition in the court challenging the reservation policy of the government.
In their application filed in the apex court today, the doctors have expressed ''dissatisfaction'' over the writ petition already pending in the court.
''The writ petition has not raised the basic issue regarding wholesome review of the reservation policy for the consideration of the court,'' they said.
The doctors in their charter of demands have demanded setting up of a non-political commission to review the existing reservation policy.
They have also demanded that if the findings of the experts committee were different from the Mandal Committe report or provides for a new basis for following the policy, then this report should prevail over the Mandal Commission report.
The Mandal Committee had recommended 27.5 per cent reservation for OBCs, saying that their population in the country was 52 per cent of the total population.
The apex court, however, made it clear that it could not prevent the Parliament from amending the Constitution or law.
A vacation bench, comprising Justice Arijit Pasayat and Justice Lokeshwar Singh Panta, made the remarks in response to a query made by Mr Sushil Kumar Jain, counsel for the doctors.
The query was apparently inspired by the recent move of the government which enacted the law to put a one-year moratorium against removal of unauthorised and illegal constructions in Delhi to upset the orders of the SC and High Court.
All commericial premises operating from residential areas in the city, which were sealed under the apex court order, have been de-sealed following the enactment of the Delhi Laws (Special Provisions Act 2006).
