HC orders FIR against Chandigarh Doc in Jessica case
New Delhi, May 31: The Delhi High Court has ordered the police to institute an FIR against Chandigarh-based doctor J S Gill for misleading the trial court by furnishing fake medical certificates which led the court to exempt Vikas Gill, an accused in Jessica Lal murder case, from personal appearances in the court.
Justice R S Sodhi and Justice P K Bhasin observed that the doctor should also be summoned before the court on the next date of hearing in the case.
Delhi police had declared Vikas Gill a proclaimed offender since he had left the country without permission of the court during the pendency of the case.
The counsel for Dr J S Gill submitted before the court that he had issued the certificates because the person claiming himself to be Vikas Gill had produced medical presriptions.
Besides, he had no means to ascertain the identity, the counsel submitted.
The Division Bench issued notices to the accused on an application moved by the prosecution seeking a fresh ballistics examination of the empty cartridges recovered from the scene of offence.
State counsel Mukta Gupta also sought permission from the court to send two cartridges, allegedly fired by the accused killing Jessica Lal on the spot, for a board of experts to give a final and fair opinion about the nature of the bullets because the CBI and the Central Forensic and Science Laboratory held opposite views.
The court has posted 31 July for the next date of hearing.
