Petition seeks Amar Singh's disqualification for Parliament
New Delhi, May 30 (UNI) The Delhi High Court today issued notices to the union government and the Election Commission on a petition filed by Jain TV owner and former BJP MP J K Jain seeking disqualification of Samajwadi Party leader Amar Singh and 45 other MPs for holding offices of profit.
Despite official reference by the President of India since May 8, 2006, the Election Commission's yet to give its reply in case of 46 MPs for holding office of profit, said Mr Jain, appearing in person.
''The EC failed to accord similar treatment (as in the case of Jaya Bachchan) in advising the President in other cases referred to it by the President. Admittedly the cases of 46 MPs are lying with the EC without any known justification for keeping them pending and thus it is not performing its constitutional duty under Article 103,''said the petition.
A division bench of acting Chief Justice Vijender Jain and Justice Kailash Gambhir issued notices to the Centre, EC and Ministry of Law and Justice to file their replies by July 25, the next date of hearing.
