SC issues notice for issuing notification to circumvent the SC orde

New Delhi, Apr 28 (UNI) The Supreme Court issued notices on a writ petition challenging the validity of central government notification dated March 28, 2006 on the ground that it was issued with a view to circumvent the court's order ordering sealing of commercial premises operating from residential areas in Delhi.

A bench comprising Chief Justice Y K Sabharwal and Mr Justice C K Thakkar, however, refused to grant interim stay on the operation of the impugned notification.

It may be noted that the Union Urban Development Ministry issued the notification at night on March 28 permitting mixed land use in Delhi while the Supreme Court monitored sealing prosess was due to start from March 29,2006.

The Chief Justice remarks that the notification did not upset the Supreme Court order but it did create confusion about the continuation of the sealing process in Delhi.

In all 189 roads have been identified in Delhi where people are indulging in misuse of their residential premises by using it for commercial purposes.

It may also be noted that the political powers cutting across party lines have been trying their level best to shield and protect the law-violators.

In this context, Union Urban Development Minister S Jaipal Reddy has publicly declared that in case centre fails to get any relief from the Supreme Court the government shall bring a bill to legalise the mixed land use which shall also legalise the illegal commercial establishments operating from residentail areas in gross violation of Delhi master plan.
