Court grants 15-days relief to a Doctor occupying illegal building

New Delhi, Apr 27 (UNI) The Delhi High Court for the first time, today directed the Municipal Corporation of Delhi (MCD) not to demolish a building occupied by a doctor couple in East Patel Nagar in Central Delhi for 15 days.

A Division bench of Acting Chief Justice Vijender Jain and Justice Rekha Sharma asked Dr Rajesh Mahajan to remove the unauthorised portion from the building at 26/7 East Patel Nagar by May 12 at his own cost.

''Let the petitioners themselves demolish the unauthorised portions and comply to the sanctioned parameters within two weeks,'' said the order.

In a petition Dr Mahajan and his wife Dr Sikha Mahajan prayed that they should be given some time to remove the illegal portions as they were ignorant that the structure did not confirm to building bylaws.

The Court asked the couple to submit an undertaking before the court within three days that they would abide by the court order.

The MCD Central Zone Executive Engineer was directed to inspect the building on May 12 and file a report before the authorities.

Court Commissioner Pushkar Sood was asked to visit the building on May 13 and file a repot before the court.

If the structure did not comply to the bylaws by May 13, the MCD would demolish the building.

Yesterday, the MCD demolished the fourth floor of the building, which was not constructed according to the plan apporved by the local authorities.

The builder had bought the land with an old building and after demolishing it built four stories flouting the building bylaws.

The Doctors had bought the ground floor in April 2005 without verifying the facts from the MCD authorities.
