Major setback by SC to group housing society of Central Govt

New Delhi, Apr 25 (UNI) In a major setback to Kendriya Karamchari Sahkari Grih Nirman Samiti, group housing society of central government employees , the Supreme Court has restored 3,23,650 sq.

m. of land to the New Okhla Industrial Development Authority (NOIDA) which was got allotted fraudulently on the basis of bogus list of society members.

A bench comprising Mr. Justice Arijit Pasayat and Mr. Justice Tarun Chatterjee vide judgment dated April 24 has set aside the Allahabad high court judgment reversing the order of NOIDA to cancel the allotment of land to 1754 members of the society.

The society claimed that 292 bighas of land belonging to it had been forcibly acquired by the government and hence society members were entitled to the allottment of 40 per cent of the total land acquired as per the policy of NOIDA.

Society president Balbir Singh sent a list of 1754 members purportedly verified by the assistant registrar of group housing societies and believing it to be correct the NOIDA allotted land to individual members in Feb. and March 1995. Payments for land were also accepted. NOIDA later received several complaints alleging that they were the real members of the society and their names have been fraudulently excluded from the list of members sent to the Authority. Uttar Pradesh governor's office also wrote a letter dated Oct.4,1996, forwarding the complaints lodged by several persons claiming to be the members of the society whose names were deliberately and fradulently held back by the society office- bearers.

Noida authority asked the society secretary for details which the society kept on delaying.

The names of the members were in fact verified by society President Balbir Singh instead of assistant registrar, co-operative societies.
